This Service Disclosure ("Disclosure") pertains to the apostille and legalization services provided by Homestretch Notary, LLC ("Company"). By engaging in apostille and legalization services with the Company, you ("Customer") acknowledge and agree to the following terms:
General Terms: This General Terms Agreement shall confirm that the Customer hereby grants authorization to the Company, acting as their representative, for the purpose of obtaining apostilles and/or legalization on their behalf. It is explicitly agreed by the Customer that they shall indemnify and hold the Company and/or its agents harmless from any and all liabilities, including but not limited to attorney's fees, which may arise as a result of the aforementioned undertaking.
The Company acknowledges that it cannot guarantee the exact shipping and/or delivery times of the documents, and hereby disclaims any responsibility for the actions or omissions of mail providers, government authorities, or any third parties involved in handling the Customer's documents during the process. Although the Company shall provide an estimated time frame, it is strongly advised that the Customer allocate a sufficient amount of time to allow for the processing of the documents. Furthermore, the Company cannot assume liability for any events arising from force majeure or any other unforeseen circumstances.
The Customer expressly understands and acknowledges that it is their sole responsibility to ascertain and comply with the specific requirements of the foreign country in relation to the apostille and/or legalization of the documents. Additionally, the Customer agrees to indemnify and hold the Company and/or its agents harmless in the event that the documents are rejected subsequent to the issuance of an apostille and/or legalization.
Payment Terms: Prior to the initiation and culmination of the Project, the Company shall issue invoices to the Customer. The Customer hereby acknowledges and agrees to remit at least fifty percent (50%) of the total Service Quote prior to the project's commencement, with the final payment to be settled upon the Project's completion. Failure to settle unpaid or overdue invoices may lead to a potential delay or suspension of the Project.
Termination of Service and Refund Policy: In the event of the Customer opting to terminate the service prior to its completion, it shall be incumbent upon the Customer to assume full financial responsibility for all work performed and costs incurred up until the aforementioned date. A refund will be issued for any remaining amount paid by the Customer, provided that the service has not been initiated.
Non-Refundable Situations: Please note that once the apostille process has been completed, no refunds will be granted.
Additionally, refunds will not be provided for Customer errors or inaccuracies in the submission of necessary documentation or information required for the apostille service.
Exceptions: The Company reserves the right to make exceptions to this refund policy on a case-by-case basis, at its sole discretion, to ensure fair resolution for all parties involved.
Acceptance of these Terms: By making a payment for the invoice, the Customer confirms that they have read and understood this Service Disclosure and agrees to be bound by these terms and conditions.
